In this picture was done as a request for an otter diving, there only so many diving poses honestly, add in fact otter's are natural flexible its pretty easy to see how two different artist would end up using similar poses. I did use a photo as reference for the pose.
I Don't mean come off as overly hostile. I can admire you wanting to protect someone else' work, just try not throw accusations unless there obvious tracing and stealing going on and not just a similar pose.
